Terms of Service

These terms cover pinger.ai, the free diagnostic tools on it, and the Pinger monitoring application. Pinger is operated by Ginzamarkets, Inc. Using any of it means you accept these terms.

The free tools

The diagnostic tools are free and need no account. They are rate limited so that everyone can use them. Please do not route automated or bulk traffic through them; if you need programmatic access, the API exists for that.

Only run checks against domains you own or are authorised to test. The tools make ordinary requests that any browser could make, but you are responsible for what you point them at.

Accounts

• You need an account to monitor sites. Keep your credentials to yourself; you are responsible for what happens under your account.
• You must be old enough to enter a contract where you live.
• Add only domains you own or manage. Monitoring somebody else's site without permission is not what this is for.
• We may suspend an account that is being used to attack, overload or disrupt a third party.

What Pinger does, and what it does not

Pinger checks your sites on a schedule and tells you when something changes. That is genuinely useful and it is not a guarantee. Specifically:

• Checks run on an interval, so a brief outage between checks can go unseen.
• A check runs from our infrastructure, so it reflects what we can reach rather than what every visitor experiences.
• Alerts depend on email, Slack and webhook providers we do not control.
• robots.txt tells you what a crawler is asked to do. Honouring it is voluntary, and not every crawler does.
• WHOIS, DNS and certificate data come from registries and servers we do not operate, and can be stale, rate limited or unavailable.

Pinger is a monitoring tool, not a substitute for your own operational judgement, backups or security review.

Availability

We work to keep Pinger running and we do not currently offer a contractual uptime commitment. Maintenance, upstream outages and changes to third-party services can interrupt checks and alerts.

Your data

Your account data and check history are yours. We process them to run the service, as described in the privacy policy, with the providers named on the subprocessors page. You can export or delete your data at any time.

Fees

The free tools are free. Paid plans are billed in advance for the period chosen, and fees already paid are not refundable except where the law requires it. If pricing changes, we will give notice before it applies to you.

Acceptable use

Do not use Pinger to:

• Probe, scan or stress infrastructure you are not authorised to test.
• Work around rate limits, or resell the free tools as your own service.
• Break the law, infringe someone's rights, or interfere with anyone else's use of Pinger.

Liability

Pinger is provided as is, without warranties of any kind to the extent the law allows. We are not liable for indirect or consequential loss, or for lost profits, revenue or data. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim, which for free tool users is nothing.

Put plainly: if Pinger misses an outage, we are sorry and we want to know, but we cannot be liable for what that outage cost you.

Ending the agreement

You can close your account at any time. We may suspend or close an account that breaches these terms, and where circumstances allow we will tell you why first. Sections that are meant to survive termination do, including liability and acceptable use.

Changes

We may update these terms. For material changes we will post the update here and notify account holders by email. Continuing to use Pinger after a change means accepting it.
